Help at a police station

Do I need a solicitor?

Our advice is always, if you are to be interviewed by the police you should have a solicitor present at the police station. Our solicitors will protect your rights and entitlements when under arrest, but perhaps more importantly we will be aware of the evidence that the police have and the implications that any comments you make may ultimately have on your case.

Even if you have already been interviewed and the police have imposed bailed upon you, to return to the police station, representation may be important. The police may have uncovered new evidence and want to question you about it and it is your right to have a solicitor present to protect your interests.

Will the police wait until my solicitor arrives?

It is a mistake to believe that the taking of a sample for a Drink Driving allegation can be delayed until your solicitor arrives at the police station to represent you. Refusing these tests until your solicitor arrives could mean that you end up being charged with a Refusal to Provide a Specimen for Analysis.

The police should however, within reason, wait for your solicitor to give you advice before they formally interview you in relation to any offence.

Can I be helped over the telephone if at a police station?

One of your rights and entitlements when at a police station is to speak to a solicitor free of charge. The custody sergeant will ask whether you have your own solicitor or whether you wish to speak to the advice centre free of charge. Any day or night one of our solicitors will advise you free of charge over the phone if you are arrested, so feel free to store our number now.
